Using media & copyrights

Good day

I was wondering if we are allowed to use other uploaders’ (including BrillKids’s) media from the categories & playlists that we’ve downloaded?

And if so, what happens when someone uploaded a photo that was copyrighted without permission & someone else uses it without them knowing about the copyright?  I might be wrong, but the reason I’m asking is because I’ve seen a few photo’s that I’ve seen on other websites (e.g. Webshots.com) & they were copyrighted.
If an unsuspecting person uses this copyrighted photo, will they also be liable for persecution or only the person who uploaded the photo as part of their category/playlist?
